The Real Obama Liberal Legacy is a periodic series to highlight the results of liberal progressivism put into practice.
Next up, Illegally Funding Obamacare. We're hearing a lot lately about how Obamacare is not sustainable. Remember, parts of it are also essentially illegal.
The promise: “Now, part of the reason I faced a trillion-dollar deficit when I walked in the door of the White House is because too many initiatives over the last decade were not paid for—from the Iraq war to tax breaks for the wealthy. I will not make that same mistake with health care.” —President Obama’s first State of the Union Address, 9/9/2009
The reality: The administration is so desperate to keep Obamacare in place that it's actually paying for part of the law without approval from Congress. This isn't just illegal—it's unconstitutional.
The Constitution is clear: Only Congress controls the federal purse strings. However, the administration has already paid out billions of taxpayer dollars to insurance companies under Obamacare without approval from the people's representatives.
And now, thanks to our oversight work in the House, we know that senior officials within the administration expressed concern over the lack of authority to fund the program, but they were overruled. This revelation shows that the administration knowingly ignored the Constitution in order to prop up Obamacare.
Here’s the good news: The House is suing the administration for improperly spending taxpayer dollars for this part of Obamacare. In May, a federal judge ruled that these payments are indeed unconstitutional. This was a big win for the Constitution, and now we’re taking this fight to the Supreme Court.
There is a better way: House Republicans recently proposed a strong replacement plan that will drive down costs and put patients in control of their health care. There is a better way to give every American access to quality, affordable health care. Learn more at better.gop.
