Pelosi Statement on House Victory in D.C. Court of Appeals in Border Wall Case
Washington, D.C. – Speaker Nancy Pelosi issued this statement after the U.S. Court of Appeals for the D.C. Circuit ruled in the case of House of Representatives v. Steven Mnuchin, et al. that the House has standing to pursue its litigation against the Trump Administration’s illegal attempt to transfer Congressionally-appropriated funds to build his border wall:
“Today, the D.C. Circuit Court of Appeals unequivocally held that Congress, not the President, has the exclusive power of the purse. This ruling, allowing the House to proceed with its lawsuit to enforce the Appropriations Clause, is a strong victory for the Constitution and the rule of law, and upholds our Founders’ vision for our democracy, with three co-equal branches serving as a check and balance on the others.
“On a bipartisan basis, Congress has repeatedly refused to fund the President’s immoral, ineffective and wasteful border wall. Yet, the Administration continues its illegal campaign to divert critical funding from national security and military construction projects that are essential to keep our troops, their families and all Americans safe. The House of Representatives is committed to upholding our authority as the first branch of government to ensure that funds appropriated by Congress for these vital initiatives are used as directed.
“With this ruling, the House will continue to fight in the Courts and in Congress to uphold the Constitution and ensure the President cannot negate the separation of powers and the will of the American people in order to fulfill an outrageous campaign promise.”
